Case against Dhanush dismissed
The court also denied DNA profiling of Dhanush .
Madurai: The actor Dhanush at last got a reprieve with the Madurai Bench of the Madras high court finding no prima facie case in the maintenance suit filed by a couple from Melur, who came into the limelight after claiming that the Adukalam star was their long lost son.
Quashing the maintenance petition filed by the couple, R. Kathiresan (65) and Meenakshi (53), who claimed paternity after a gap of nearly 14 years, Justice PN Prakash on Friday observed that, “This court is of the view that the Kathiresan couple has not made out a prima facie case for trial and their petition is devoid of merits”.
The court also denied DNA profiling of Dhanush citing the Supreme Court judgment which held in unequivocal language that the person who wants a DNA examination to be done should make out a prima facie case for the court to exercise its power.
It was not the case of the couple's child Kalaichelvan went missing at very young age or it was kidnapped and later the child metamorphosed into Dhanush. Instead it was a specific case that their son Kalaichelvan ran away while he was pursuing Class 11 in Arumugampillai Seethaiyammal Higher Secondary School, Thirupatthur, Sivagangai sometime in 2002, the court pointed out. The judge also made it clear that the medical examination to check for identification marks of Dhanush was done on the orders of this court only for it to be satisfied as to whether there are prima facie materials in the assertion of the Kathiresan couple. Hence there was no necessity for cross examination of doctors as demanded by the couple. The court also dismissed the contention of the Melur couple on Kasthuri Raja and his wife Vijayalakshmi community issue and also the actor changing his name from R.K. Vengadesha Prabhu to Dhanush and his father from Krishnamoorthy to Kasthuri Raja. The court accepted the quash petition filed by the actor.
