Original driving licence case: Madras High Court to pass detailed order

Chennai: The Madras high court will soon pass an order on a petition challenging the recent government notification directing the motorists to carry original driving licence while driving vehicle.

When a petition filed by All India Confederation of Goods Vehicle Owners Association, challenging the notification came up for hearing on Friday, the first bench comprising Chief Justice Indira Banerjee and Justice M. Sundar informed this.

Earlier, the Tamil Nadu transport department insisted that carrying original driving licence by motorists while driving vehicles indispensable.

 Appearing for the petitioners, counsel R. Subramanian submitted section 139 of Motor Vehicle Rules contemplates that in case original driving license seized by any of the departments, an attested copy made by that department or by the concerned court can be shown.

Subramanian said in an order dated August 24, the DGP informed that the motorists driving vehicles without a license would be prosecuted under sections 130 and 181 of MV Act 1988 and imprisonment up to 3 months. The memorandum not sustainable in the eye of the law, he said.
