Kerala High Court flays VACB over report on Jayarajan

The court was considering a petition filed by Sudheer challenging the vigilance case registered against him.

Kochi: The Kerala High Court has expressed dissatisfaction over a report filed by the VACB in the case against former minister E.P. Jayarajan in connection with the appointment of his nephew as the Managing Director of Kerala State Industrial Enterprises.  

The court  directed the VACB to inform it what exactly was the monetary benefit or valuable thing obtained by the persons allegedly involved in the case. It observed that the statement filed by the investigating officer as regards the essential to constitute the offence under the Prevention of Corruption Act was  not satisfactory.  

“For such prosecution, the public servant or somebody else must have gained some pecuniary or valuable thing to attract the offence,” it said.

In this case, the order appointing P.K. Sudheer, nephew of Jayarajan, as Managing Director, was cancelled within three days, the court said  and posted the case to May 30 for further hearing.

The court was considering a petition filed by Sudheer challenging the vigilance case registered against him. It had earlier criticised the agency in the case.
