Hyderabad HC bars Telangana govt, engineering company from private land
Order issued on appeal by Naga Jyothi, others against single judge order.
Hyderabad: The HC on Monday directed TS revenue authorities and Navayuga Engineering Company Ltd not to enter private land in Yellur in Mahbubnagar district without the owners’ consent.
A division Bench comprising acting Chief Justice Ramesh Ranganathan and Justice A. Shankar Narayana granted the interim order on an appeal by Ms Naga Jyothi and others, challenging an order of a single judge dismissing their appeal.
Their counsel informed the court that revenue officials and representatives of the company had conducted a survey of their lands under the guise of redesigning of the Palamuru-Ranga Reddy lift irrigation scheme without following procedure listed in Section 12 of the Central Land Act, 2013.
When the appellants had moved a petition, the single judge had dismissed it following an affidavit filed by the revenue department and the company stating that they were only surveying government land.
The petitioners, however, alleged that the respondents were entering the lands of the appellants and carrying out the survey. The Bench directed the respondents not enter the lands of the appellants and issued notices to the respondents to file counter affidavits.
Agri Gold: AP to file affidavit
The High Court on Monday directed the Andhra Pradesh government to file an affidavit explaining the steps it would have taken to repay depositors of the Agri Gold if they had not moved the court.
A division Bench comprising Justices V. Ramasubramanian and S.V. Bhatt was dealing with a petition by the Telangana Agri Gold Customers and Agents’ Welfare Association seeking a Central Bureau of Investigation (CBI) probe into the cases against the company.
Mr N.S. Arjun Kumar, counsel for the petitioners, told the court that the Andhra Pradesh CID had stated that they were unable to move further in the case in view of the pendency of the Public Interest Litigation.
He informed the court that the West Bengal government had paid '500 crore to depositors from its exchequer in a similar case. The court’s poser to the CID and Andhra Pradesh counsels about what they would have done in case no case came was in reaction to this.
The Bench told the counsel to submit the plan of action for getting money to the depositors of Agri Gold consortium expeditiously and to file the affidavit in court by October 27.
