Sasikumar murder case: Madras HC grants bail to Mubarak

Chennai: The Madras high court has granted bail to Mubarak alias Mohammed Mubarak, arrested by the National Investigation Agency (NIA) in connection with the murder of Hindu Munnani leader Sasikumar on September 22, 2016, in Coimbatore district.
A division bench comprising Justices S.Vimala and S.Ramathilagam allowed the appeal filed by Mubarak, challenging an order of the special court (under NIA Act), Poonamallee, dated March 22, extending the period of detention from 90 days to 180 days.
After perusing the report filed by the public prosecutor before the special court, the bench said no specific or special reasons had been given in the report, seeking remand extension. The special court had not recorded any reason as to why the prayer for remand extension was being allowed. The report was mere indicative of the progress made in the investigation and the phases in which it needed to be made.
The reasons contained in the report cannot in any manner be said to be special or specific reason which restrained the court from releasing the accused on bail, the bench added.
