FIR registered on man who cheated SRM chairman
Counsel appearing for Gopal submitted that he will place all the materials before the police.
Chennai: The Vepery police on Monday informed the Madras high court that an FIR has been registered against D.V.Gopal, who allegedly forged a will relating to a property and sold the same to SRM group chairman Pachamuthu.
Additional public prosecutor M.Mohamed Riyaz made the submission when the petition filed by P.Rangabhashyam, came up for hearing before Justice N.Anand Venkatesh.
Riyaz submitted that the police has registered an FIR against D.V.Gopal for offences under various provisions of IPC including cheating and the investigation into the complaint given by Rangabhashyam has commenced.
Counsel appearing for Pachamuthu and his son Ravi Pachamuthu submitted that they have sufficient materials to prove that they were genuine purchasers and they would submit all the materials to the police. The police should not harass them under the guise of investigation, he added.
Counsel appearing for Gopal submitted that he will place all the materials before the police. Recording the submissions and directing the parties to place all the materials before the investigation officer, the judge said the Inspector of Police, CCB, Vepery, shall consider all the materials and file a final report as expeditiously as possible.
The judge disposed of the petition filed by Rangabhashyam, which sought a direction to the vepery police to seize the documents from the custody of the opposite parties and proceed with the investigation.
According to R.C.Paul Kanagaraj, counsel for the petitioner, the petitioner’s great grand father, who had several properties in and around Chennai, had two sons namely Duraisamy Naidu and Ramaiah Naidu. Ramaiah Naidu died interstate leaving behind Duraisamy Naidu as his legal heir.
Duraisamy Naidu has 3 sons namely Venkateswara Naidu, Punniyakotti Naidu and Sreenivasalu Naidu. Venkateswara Naidu has a son namely
D.V.Gopal. Punniyakoti naidu has 4 sons namely Rangabhashyam,Mohanarangam, Gothandaraman and Krishnamurthy. A property of 6.43 acres at Zamin Pallavaram was given to Petitioner’s father Punniyakotti Naidu under partition.
The documents pertaining to the property stands in the name of petitioner’s father from 1979. After his demise, the petitioner and his brother were maintaining the property, he added.
Paul Kanagaraj said in 1984, Gopal approached the petitioner and his brother and induced them to execute a general power of attorney in his name to plot out the lands for profit. They also executed the power of attorney.
However, since Gopal failed to keep up his promise and attempted to cheat them, they cancelled the power of attorney in 2005. While so, Gopal had executed a sale deed in respect of the same property to an extent of 4 acres in favour of SRM Group chairma Pachamuthu and his son. On coming to know that Gopal had forged a will and sold the property, they gave a complaint to the police. But the police closed the case for the reason that the petitioner did not produce the original will. Again, the petitioner preferred another complaint.
Since there was no response, the petitioner filed a petition for registration of FIR and the high court allowed the petition. However, there was no progress in the case. Hence, the petitioner filed the present petition, Paul Kanagaraj added.
