HC issues notice over foul smell from poultry farms
The Telangana High Court on Tuesday issued a notice to the veterinary and animal husbandry department of Warangal, over a writ petition complaining about foul smell arising from poultry wastage from private poultry farms. A two-judge bench comprising Chief Justice Ujjal Bhuyan and Justice N. Tukaramji directed petitioner V. Satyamurthi and private respondents to maintain proper hygiene and adjourned the matter to June 26.
HC dismisses plea against eviction from father’s house
The Telangana High Court on Tuesday dismissed a writ petition challenging the orders of a single judge bench that evicted the petitioner from a property registered in the name of her late father, under the law providing for the maintenance of parents and senior citizens.
Petitioner Mogili Vijay Laxmi had earlier filed a writ petition challenging the orders of the revenue divisional officer and subdivisional magistrate, after her mother filed a complaint, under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, alleging harassment by Laxmi and her husband for refusing to register her late husband’s property in their name.
The RDO directed Laxmi and her family to vacate the joint property, following which she approached the High Court. A single-judge bench, dismissing the petition, recorded that Laxmi was staying with her mother and directed status quo, relegating the matter to the appellant authority.
While Laxmi contended that the tribunal cannot pass an eviction order under the 2007 Act, the panel observed that it was special legislation enacted by Parliament to ensure the welfare of senior citizens. Laxmi then filed an appeal in the High Court.
On Tuesday, a two-judge bench of Chief Justice Ujjal Bhuyan and Justice N. Tukaramji observed that the tribunal has the power not only to decide maintenance but also other issues relating to senior citizens. The bench said that Section 15 of the Act provides for the constitution of appellant authority by the state government, while Section 16 of the Act deals with the appeals to the appellant authority. The bench dismissed the appeal by observing that the single judge was justified in relegating it to the appellant authority.
HC allows plea against HT power lines set up
Justice M. Sudheer Kumar of the Telangana High Court allowed a writ petition filed by landowners challenging the installation of high-tension power lines in Ranga Reddy district. Petitioners Rapaka Radhika Reddy and two others contended that Warora Kurnool Transmission Limited had not given any notice or paid compensation for the land on which the towers were installed. The judge allowed the writ petition on the ground that the villages concerned, for which the high-tension wires and the towers were being laid, were not informed.
