Hyderabad: A division bench comprising Justice Raghavendra Singh Chauhan and Justice T. Amarnath Goud of the Telangana High Court expressed deep concern at the diminishing moral values among young couples who were disowning their parents.

The bench was dealing with an appeal petition in which the son wanted the court to stay an order by a single judge court directing him to vacate a flat owned by his mother and restore the flat to her.

Justice Chauhan said that India is facing the same situation as the USA in the 1990s wherein parents were forced to stay at nursing care centres, because their children would not take care of them. He said he was worried about a similar situation occurring in this country.

V. Sashikiran and his wife Pushpalatha resided in his mother Siva Lakshmi’s flat at Addaguttata in KPHB Colony. He approached the court with an appeal challenging a single judge order which directed the police to restore possession of the flat to his mother within three weeks.

The single judge had given the directions on March 8, 2019, when the mother approached the court seeking restoration of her property from her son and daughter-in-law, alleging that they had forcibly thrown her out of her own property.

The division bench refused to stay the order and said, “Instead of approaching the courts for relief, why do you not go to your mother and fall at her feet requesting her to allow you to stay in her house.”

The bench expressed its anguish at the appeal being filed on an urgent basis and said that it wanted to impose a fine of Rs 5 lakh, but did not do on humanitarian grounds.

The court directed the KPHB police to take immediate steps to restore the property to the mother and told the mother to file a contempt case if the orders are not complied with by the police.
