Expedite High Court split, Amit Shah told

Hyderabad: The TS BJP’s legal cell has urged party president Amit Shah to take steps for the immediate bifurcation of the High Court and also take steps to prevent the police from misusing Section 41 –A of the CrPC.
A delegation, lead by state BJP legal cell convener Ravinder Viswanath met the BJP chief and complained that accused and advocates are facing problems due to misuse of the Section by the police.
Submitting a representation, they said that Section 41-A was introduced by way of an amendment to the CrPC in 2010 and it allows a police officer to summon a person against whom a complaint is lodged for commission of offences that invite imprisonment for up to seven years in jail. The Section makes it incumbent on the accused to comply with the summons.
The Section empowers the police officer to record reasons for accepting the remands which the court takes as the prima facie reasons and orders judicial custody, depending on the gravity of the offence.
Despite the guidelines of the Supreme Court in implementing the Section, the police officers are misusing it due to which the rights of the accused are being affected, they said.
Reminding that the Union law minister has specifically said that the Centre intends to bring in a Special Bail Bill to overcome the problem, they urged the BJP chief to take steps to introduce the Bill.
Explaining the problems being faced by advocates and litigants due to non-bifurcation of the High Court, the leaders urged Amit Shah to intervene.
