Kerala High Court dismisses Zakir Hussain bail plea

The court refused to consider his contention. Zakir moved the court after Ernakulam Principal Sessions Court dismissed his plea.

Kochi: The Kerala High Court on Thursday dismissed the bail application of CPM leader Zakir Hussain, an accused in the abduction of a businessman in Kochi.  The police will  produce Zakir before the magistrate on Friday when  his judicial custody period will expire. A single bench dismissed the bail application after Zakir moved the court stating that the police had not sought his custody and so his continued detention was  unwarranted. The court refused to consider his contention. Zakir moved the court after Ernakulam Principal Sessions Court dismissed his plea.

The sessions court had observed that the police not seeking custody was  not a valid ground to get bail. Zakir's accomplice Sheela Thomas, who is absconding, has moved the court seeking anticipatory bail in the case.   The prosecution case is that Zakir Hussain at the instance of Sheela Thomas had kidnapped  Juby Paulose  who  filed a complaint at the Palarivattom police station. Sheela Thomas had sought Zakir's help to settle a business rivalry, it was alleged.
