State to appeal against Kerala Apartment Ownership Act

THIRUVANANTHAPURAM: Even as the woes of flat owners continue owing to lack of proper legal cover, the government is planning to file an appeal against an earlier high court order to enforce the Kerala Apartment Ownership (KAO) Act of 1983.

A registration department official said the matter had to be dealt with by the housing authority and hence it was decided to file an appeal. After a series of discussions, the matter was referred to the advocate general’s office for further steps.

Meanwhile, Apartment Owners’ Apex Association president V.K. Sankarankutty said they were also planning to file a contempt petition against the government for not initiating steps to enforce the Act despite the court directive.

DC reported on Tuesday that no steps were taken on a high court directive in 2014 December to facilitate registration of flats under the KAO Act. Sources in the sector said since the KAO Act was not being enforced almost all associations of apartment owners were now being registered under the Travancore Cochin Literary and Scientific Charitable Trust Act, 1955. However, it did not give any relief to the woes of customers.
