Petitioner Fined for Using Public Law Remedy for Private Complaint

VIJAYAWADA: Justice G. Ramakrishna Prasad of the Andhra Pradesh High Court imposed cost of Rs 25,000 on Chintada Anuradha for using a public law remedy to clear a private grievance against the director of Vignana Education Development Society.

The petitioner is the wife of the said director along with whom she claims to have registered an educational society. She complained that the director had played a fraud against students, the education society and the government.

She alleged that he brought into existence some fictitious and illegal activities and fake documents of the CID having registered a criminal case. She also alleged that the director was trying to raise constructions on her properties without any permission or approval. She pointed out that she had also complained to the authorities of the health department and medical education. She said that her complaint to Bank of Baroda to freeze his accounts did not yield any results.

In the course of hearing, it was suggested that the matter be referred to conciliation. Soon thereafter the judge pointed that the said suggestion was clearly indicative that the grievance of the petitioner was purely civil in nature. The court pointed out that the petitioner had camouflaged her grievance as if it were a public law grievance to invoke the writ jurisdiction of the High Court. The judge accordingly dismissed the writ petition with costs.
