Bhuyan said that being sensitive, alert, ability to perceive while being neutral, good communication skills will improve mediation process
Hyderabad : Telangana High Court judge Justice Ujjal Bhuyan explained how mediation was different from the adjudicatory process and other modes of ADR (alternative dispute resolution). He pointed out that mediation was informal, confidential and allowed parties to interact on a one-on-one basis. It was inexpensive and interest-based.
He was speaking at the inaugural of the first mediation refresher training course at the International Arbitration and Mediation Centre, Hyderabad here on Saturday.
Highlighting the role and functions of a mediator, Justice Bhuyan explained that a mediator would not impose a solution but created a conducive environment in which the parties at loggerheads could amicably resolve their disputes.
He said that a mediator removed obstacles, identified issues and explored viable options while facilitating mutually acceptable agreements.
Speaking about qualities that made a good mediator, Justice Bhuyan said that being sensitive, alert, ability to perceive while being neutral, good communication skills and abiding by the code of conduct will improve the mediation process as a whole. Mediation was a skilled art that needed to be constantly upgraded.
The registrar of IAMC, Hyderabad, Tariq Khan, said that the centre would continue to organise such events in order to usher in a mediation culture in the state.
