Chennai: Realtor to be compensated for threat to file false case
Salavudeen lodged a criminal complaint against Mr Nainar in the Tenkasi police station.
Chennai: The State Human Rights Commission directed two cops from Tiruneveli district to pay a compensation of Rs 75,000 to a realtor for threatening to implicate him in false cases eight years ago.
In his petition, Mr Mohamed Nainar of Achanputhur village, Tirunelveli district, a realtor, stated that one Salavudeen, who was also in the real estate business, had borrowed `3 lakh from him on September 4, 2011, after assuring that he would repay the amount within a month.
Mr Salavudeen also Mr Nainar gave a cheque (No. 573687) issued by Canara Bank, Sengottai.
When Mr Nainar deposited the cheque in the Pandian Grama Bank, Neduvayal branch, it was returned on November 30, 2011 citing insufficient funds. He issued notice through his advocate to Mr Salavudeen under the Negotiable Instrument Act.
Mr Salavudeen lodged a criminal complaint against Mr Nainar in the Tenkasi police station. Following this, Mr Nainar said, inspector N. Thiruppathi and head constable A. Perumal of the Tenkasi police summoned him for inquiry.
Mr Nainar told the commission that the police personnel threatened him that if he failed to return the cheque to Mr Salavudeen, he would be implicated in a number of criminal cases that were pending in the police station and detained.
Frightened by this, Mr Nainar handed over the cheque to the inspector, he told the commission. Mr Thiruppathi and Mr Perumal misused their power and threatened him to return the cheque and to foist false against him, he told the commission. He sought action against them for violating his human rights.
