Hyderabad High Court grants stay on flyover construction
The company told the court that when they submitted their objections, the collector rejected it and issued proceedings for the land acquisition.
Hyderabad: In a set back to the Greater Hyderabad Municipal Corporation (GHMC), the Hyderabad High Court has granted stay on the construction of Flyover Bridge at Bio Diversity Park in Gachibowli area of the city.
Justice M.S. Ramacha-ndra Rao, while dealing with a petition by M/s. Asian Global Infra Pvt. Ltd challenging the action of the authorities in passing award for compensation without hearing their objection for acquiring their 1,310 sq. yards at Gachibowli for road widening, granted the interim stay.
The petitioner submitted that it had 2,515 sq. yards of open land at Gachibowli and when they wanted to exploit the said plot by constructing a commercial complex, the GHMC refused to accept the application without citing any reason and meanwhile the land acquisition officer issued notice under Section 4 of the Land Acquisition Act 2013 proposing to acquire petitioner’s land for widening the road to 65 metres.
Earlier, the High Court has directed the district collector to consider the objections of the petitioner as the land has been acquired from one side of the road.
