Telangana HC sets aside SCR's termination of RUB contract
Hyderabad: Justice S. Nanda set aside an order of the South Central Railway (SCR) terminating a contract for a road under bridge (RUB) under the Guntakal division. It had awarded 10 works to Sanyu Infra Projects pvt. ltd and all of them were cancelled in May 2022. The said order was set aside by a division bench earlier.
The bench directed the railways to hear the petitioner afresh and communicate its order either by registered post or through the registered e-mail Id of the petitioner. Senior counsel L. Ravichander, appearing for the petitioner, pointed out that the impugned action reflected a total violation of the earlier order.
The petitioner said that a mere reading of the order would show that it was not supported by any reasoning. It was a mechanical reiteration of its earlier order and therefore a violation of the order of the division bench order. He also pointed out that it was not communicated to the writ petitioner at its registered e-mail Id.
The senior counsel argued that the action of the authorities not only bordered on being contemptuous but also violated the fundamental rights of the petitioner. Justice Nanda allowed the writ petitioner and set aside the termination order.
