Forum asks job portal to compensate job seeker
The company assured to refund the amount in 21 days. However, company executives did not contact him.
Chennai: The District Consumer Dispute Redressal Forum, Chennai (South) has directed an online resume service provider to pay Rs 39,000 including a refund of Rs 31,768 received from a job seeker for failure to offer him employment opportunity as promised.
The petitioner, H. Ravikanth of Egmore, submitted that Click 2 Resume Services Pvt. Ltd., Noida, has been rendering assistance to persons seeking employment and developing their resumes suitable to employers. He received a call from its executive on September 22, 2013 assuring of various job openings for him. He was asked to opt for services including resume services, resume verification service and power service and power resume services.
Hoping for a decent placement, he registered himself for seven services and paid a sum of Rs 31,768 on September 22 and 23, 2013. Without offering him any employment opportunity, the online portal on September 23, 2013 asked him to pay more money.
While refusing to pay, he cancelled all his orders and requested for refund of the amount. The company assured to refund the amount in 21 days. However, company executives did not contact him.
Dejected over this, he filed the complaint before the Chennai Police Commissioner, who transferred the complaint to the Cyber Crime Cell for further investigation.
On March 3, 2014, he sent a letter to them seeking refund of his money. As there was no reply, he filed a petition before the Consumer Forum seeking direction for refund and compensation. Even after notice, the company failed to appear before the Forum.
The bench comprising its president, B. Ramalingam, members K. Amala and Dr T. Paul Rajasekaran, said it was of the view that the website committed deficiency in service. Hence, the company has been directed to refund the entire amount of Rs 31,768 and also pay Rs 5,000 towards mental agony and also Rs 2,500 towards cost.
