TN damages plea to be heard by Supreme Court

New Delhi: The Supreme Court on Monday posted for hearing on August 8 a suit filed by Tamil Nadu seeking Rs 2,500 cr damages from Karnataka for loss of samba and kuruvai crops during 2012-2013 due to non release of Cauvery waters on the basis of the distress water sharing formula as per the interim award of the Cauvery Water Disputes Tribunal.
The suit filed in 2013 came up for hearing before a bench of Justices V. Gopala Gowda and A.K. Goel. Senior counsel Fali Nariman for Karnataka pointed out that before framing of issues, the documents filed by the parties should be verified before the Registrar concerned. The Bench accepted the submission and asked the counsel for the parties to approach the Registrar on July 27 for verification of documents and directed the suit to be listed on August 6 for framing of issues.

The State pointed out that in the last 21 years there was no voluntary release of water from the reservoirs during the crucial months of June to September as per the Interim Order of the Tribunal. The Scheme framed by the Central Government for implementation of the Interim Order had failed to ensure and protect the rights of inhabitants of the Plaintiff State.
