Trademark row: Madras HC restrains hotel in Triplicane
Their hotel acquired popularity in Triplicane, all over Chennai and in Kerala also.
Chennai: The Madras high court has restrained M/s Hotel New Sealord in Triplicane from in any manner passing off the trade mark and trading style “Hotel Sealord” by using the offending trademark and trading style “Hotel New Sealord” or any other mark or marks similar or deceptively similar to trade mark “Hotel Sealord”.
Justice Krishnan Ramaswamy granted the interim injunction while ordering notice, returnable by July 4, to M/s Hotel New Sealord on an application arising out of a suit filed by M/s Hotel Sealord represented by its partner K.M.Kutty.
Applicant’s counsel Vijayan Subramanian submitted that as a sole proprietor K.M.Kutty commenced hotel business under the name of “Hotel Sealord” at Triplicane high road during 1976. He commenced the hotel business as a tenant. Subsequently, in 1996 he commenced a partnership firm under the same name to run the hotel business at the same premises to expand the hotel business. Their hotel acquired popularity in Triplicane, all over Chennai and in Kerala also. Even the people who were coming to Chennai from Dubai and other Asian countries were regular visitors of the applicant hotel ‘Hotel Sealord’, he added. Vijayan Subramanian said the trademark and trading style “Hotel Sealord” was being associated with the original business commenced by K.M.Kutty.
