HC frees PD Act detainee

Hyderabad: A two-judge bench of the Telangana High Court on Monday ordered notice to authorities in a writ petition questioning whether a person charged of any economic offence could be detained under the Preventive Detention Act.

The bench, comprising Justice Abhinand Kumar Shavili and Justice Pulla Karthik,
was dealing with a habeas corpus petition filed by Karan Kumar seeking the
release of his brother Mukesh Kumar.

The petitioner pointed out that a person accused of economic offences cannot be a matter of public order', justifying such detention. It was also contended that preventive detention cannot be enforced in perpetuity while trial is pending. The petitioner pointed out that the ground cited was that the detainee had not violated or flouted conditions of the granted bail. The bench ordered the detainee to be
freed.
