State Consumer Commission order helps credit card holders in getting compensation

Hyderabad: The Telangana State Consumer Disputes Redressal Commission in Hyderabad has ordered ICICI Bank to pay compensation of Rs 50,000 and cover legal charges of Rs 10,000 to a victim whose credit card was misused by cybercriminals.

The case was brought forward by 58-year-old businessman Samir Patel, a resident of Trimulgherry, who had been a credit card holder with ICICI Bank since 2013. On January 16, 2022, Patel received notifications on his mobile phone about five unauthorised transactions totalling Rs 1.91 lakh, carried out in Bareilly while he was in Hyderabad with the card in his possession. Patel immediately lodged a complaint with the Cybercrime police.

Following the fraud, ICICI Bank issued Patel a bill for Rs 1.91 lakh, which he contested. The bank argued that the complainant had linked his credit card to a payment gateway, Samsung Pay, and had been sent an OTP on the day of the fraudulent transactions.

In 2023, the Hyderabad District Consumer Commission-III ruled in favour of Patel, directing the bank to withdraw the bill and compensate him with Rs 2 lakh. Patel then filed an appeal with the State Consumer Commission, which heard the case and reaffirmed that the bank should compensate Patel with Rs 50,000 for issuing a bill after the cyber fraud, along with legal fees of Rs 10,000.
