Telangana HC registry declines plea against Kadiyam Kavya

Hyderabad: The Registry of the Telangana High Court has declined to register the petition filed against Kadiyam Kavya as a writ petition. The petition alleged that she does not belong to the Scheduled Caste and therefore sought to prevent the Election Commission from declaring her election as Member of Parliament from the Warangal Constituency, which is reserved for SC candidates.
However, the High Court Registry declined to register the petition as a writ, citing that the election results have already been announced.
Dr Gaddam Mallesh, a contestant in the recently concluded Lok Sabha elections from the Warangal (SC) constituency, filed a petition urging the court to direct the Election Commission of India (ECI) to invalidate Kadiam Kavya's candidature. He argued that Kavya misrepresented her caste as "Scheduled Caste" despite being married to a Muslim man.
Dr Mallesh asserted that Kavya's marriage to Md Nazirulla Shaik led to her conversion to the Muslim community, thereby forfeiting her original SC status. He claimed that her nomination as an SC candidate was based on misrepresentation and should be deemed invalid.
However, the High Court Registry declined to register the petition as a writ, citing that the election results have already been announced.
