Contract lecturers in tribal welfare schools get HC boost

HYDERABAD: The Telangana High Court directed the state government and Telangana State Tribal Welfare Residential Educational Institutions Society (TSTWREI) to implement regular pension as per the revised pension rules, 1980 to the teaching staff, recruited on contract basis from 2000 to 2003 on a consolidated pay.

Justice E.V. Venugopal was dealing with a petition filed by 121 junior lecturers and other teaching staff, whose services were regularized after selection of contact basis. Their grievance was that the society was not counting the past service of the petitioners rendered on contract basis from the date of their respective appointments.

They were filled up in regular posts on contract basis against the sanctioned regular posts from 1996 to 2003 by following the prescribed procedure. The services of such contract teachers were regularized, on March 4, 2004.

But, stating that there was some ambiguity in the G.O with regard to the actual date for regularization of the petitioners, the date of regularization of the services of the petitioners was fixed as 15.12.2008, instead of regularising them from the date of their initial appointment. The society issued a circular threatening to stop their salaries and implement the contributory pension scheme (CPS) of 2004 from December 2018. Challenging it, the petitioners approached the High Court.

The judge opined that the services of the petitioners should be taken into account from the date of their initial appointments and they would come under the provisions of the Revised Pension Rules, 1980. They cannot be subject to take shelter of the G.O.Ms.No.655, dated 22.09.2004, which was introduced to implement CPS on those recruited on or after 01.09.2004. Admittedly, the petitioners are in service from 2002, he said.
