HC Grants Interim Stay on Sale of Ferocious Dog Breeds
Hyderabad: Justice B. Vijaysen Reddy of the Telangana High Court granted interim stay of the notification made in March banning import, breeding and sale of certain ‘ferocious’ dog breeds, including cover mixed and crossbreeds like rottweiler, pitbull terrier, wolf dogs, and mastiffs, as they were dangerous for human life.
The petitioner, Fareedunnisa Huma, filed a writ petition challenging the notification, which directed the local bodies to refrain from issuing licenses or permits for selling and breeding of these dogs and for implementing measures to sterilize those kept as pets and thereby prevent future breeding.
The petitioner pointed out that the notification was devoid of scientific basis and violated the fundamental rights of pet parents and those connected to the pet industry and was therefore arbitrary and ultra vires the Constitution.
The court was informed of an order by the Kerala High Court granting an interim stay on the notification. The judge accordingly granted an interim stay and ordered issuance of notice to the state and Central governments.
