Telangana HC Suspends One-Month Imprisonment of Two Officials

Hyderabad: A two-judge bench of the Telangana High Court suspended a sentence of one-month imprisonment, in a contempt appeal filed by the sub-inspector of Shivampet police station and sub-divisional police officer, Toopran, Medak. The panel, comprising Chief Justice Alok Aradhe and Justice J. Anil Kumar, took on file two connected statutory contempt appeals filed by V. Ravikanth Rao and Yadagiri Reddy. The complaint of contempt before the single judge related to the ‘plucking of mangoes’ contrary to directions given by the single judge. A single judge of the High Court had observed that “respondents were very much aware of the directions of this Court and only in order to circumvent the order and appropriate the crop before they receive the copy of the order, it is clear that they have proceeded to take away the mango crop” and committed willful disobedience. Earlier, a similar contempt appeal was filed and it was contended that there is no finding recorded in the impugned order that the appellants had willfully disobeyed the interim order passed by the single judge. The panel considering the interim orders passed in two similar appeals suspended the sentence subject to the appellants depositing the fine imposed.

Don’t interfere in agri land issue, forest officials told

Justice N.V. Shravan Kumar of the Telangana High Court injuncted forest department authorities, Sircilla district, and directed them not to interfere with the peaceful possession of the landowners of agricultural land at Anantharam, Sircilla district. The judge was hearing a writ plea filed by Akula Manjula and seven others, complaining that the respondent authorities were restricting the petitioners from cultivating on their agricultural land. The petitioners stated that earlier the High Court had ordered the revenue authorities to conduct a joint survey of the land in survey numbers 651 and 652 of Anantharam in the presence of the petitioners and forest authorities. In compliance with the same, the panchnama was drawn and boundaries fixed. Based on the same, the petitioners used barbed wires and boundary stones to demarcate their respective land holdings. The petitioners alleged that despite the conclusion of survey and demarcation of boundaries in respect of the petitioner’s land, the forest section officer had unearthed and damaged the boundaries on the ground that she did not agree with the findings of the joint survey. The judge directed the respondent authorities to file their reply and posted the matter for further adjudication.

Notice to home secretary, DGP in contempt case

Justice T. Madhavi Devi of the Telangana High Court ordered notice in a contempt case to the principal secretary (home), the DGP and other respondent authorities. The judge was dealing with a contempt case filed by N. Venkatesh, ACP in Khammam district. The petitioner alleged that the respondent authorities had wantonly violated the orders of the court. Earlier, the judge had directed the respondent authorities to consider the representation of the petitioner and extend the benefit of seniority from the date of his initial appointment for promotion to DSP on par with similarly situated persons with all consequential benefits. After hearing the petitioner, the judge ordered notice and adjourned the matter for further adjudication.

HC dismisses widow’s plea for freedom fighters pension

Justice C.V. Bhaskar Reddy of the Telangana High Court dismissed a writ plea challenging the action of the ministry of home affairs (freedom fighters division) in refusing sanction of freedom fighters' pension to the widow of a freedom fighter. The judge was dealing with a writ plea of Y. Seetaramamma, who claimed that her deceased husband had fulfilled the criteria set forth by the government for being eligible for a pension. The judge, on perusal of material papers, observed that the petitioner's husband did not meet the specific criteria laid down for eligibility under the existing government directives.

Notice to SPF chief on compassionate grounds job

Justice Pulla Karthik of the Telangana High Court ordered notice to the Director General of Telangana State Special Protection Force and other respondents in a writ plea challenging the rejection of a person’s appointment on compassionate grounds. The judge was hearing a writ plea filed by Chippalapally Sai Babu, who alleged that the respondent authorities were illegally seeking no-objection certificates from all members of the household for his appointment on compassionate grounds on account of the death of his father. The petitioner alleged that the conduct of the respondents was illegal and liable to be set aside. The judge, however, adjourned the matter for further adjudication.
