SC Stays Kadapa District Court Order Imposing Curbs on Making Comments on Viveka Murder

Vijayawada: The Supreme Court on Friday stayed the order issued by the district court in Kadapa in AP, imposing curbs on AP Congress chief Y.S. Sharmila and others, for making comments on the murder of former minister Y.S. Vivekananda Reddy.

A two-judge bench comprising Justices Bhushan Ramakrishna Gavai and Sandeep Mehta held the hearing on the plea of Sharmila in New Delhi on Friday, challenging the order of the AP High Court which had disposed the district court’s order given on April 16.

Sharmila’s counsel Gaurav Agarwal prayed for the issue of a stay order.

The court observed that the district court even without providing any opportunity for being heard to the defendants, including Sharmila, had passed the order of injunction which was having serious ramifications. It opined that the injunction would curtail the rights of the freedom of speech and expression of the defendant and expressed its inclination to stay the order of Kadapa court. It posted the next hearing of the matter after summer vacation.
