Car Hitting Case: Actress Dimple Approaches HC

Hyderabad: Actress Dimple Hayathi, who is in news recently with the news of hitting official vehicle of DCP Traffic I of Hyderabad city Rahul Hegde with her BMW vehicle, has approached the High Court to quash the case against her in the said incident.

The Jubilee Hills police has registered the case against her on charges of assault or criminal force to defer the public servant from discharge of his duties and wrongful confinement and also rash driving and riding on public way.

Hayathi mentioned in the petition that the Jubilee Hills police were influenced and lodged the case against her based on the complaint of the driver M. Chetan Kumar and who had given a complaint on an unknown name of DCP (Traffic police). She mentioned that the defacto complainant has misused his official capacity of being a police officer. Further, she submits that it is not possible that the Fortuner, the police vehicle which is strong and heavy body got damaged when it was hit by BMW car, which is very smaller in size and delicate compared to Fortuner. Victor David, her advocate also co-petitioner in the said petition of Dimple and brought to the notice of the court that the police are calling him to attend before them and he complained that the police are not following the Criminal Procedure Code in calling him and Dimple to the police station.

After hearing the case, the Court directed the Jubilee Hills police to follow the due procedure in calling the petitioners to the police station for investigation. Section 41-A CrPC notices to be issued to the petitioners by the police, when they call the petitioners. However, police informed the court that they had already issued 41-A notices to Dimple to appear before them.
