Hyderabad: Realty firm told to refund buyers' money

Suchirindia failed to develop the layout that was promised.

Hyderabad: In two separate cases, the Hyderabad District Consumer Disputes Redressal Forum-2 has ordered real estate developer Suchirindia Infratech Private Limited to refund money to two plot buyers with interest as the company failed to develop the layout.

The forum didn’t buy the argument of the company that since all plot buyers hadn’t paid yet they didn’t develop the layout.

In one case, G. Krishnaveni, 58, a resident of Teachers Colony in East Marredpally, filed a complaint seeking refund of Rs 5.75 lakh with interest and also sought compensation of Rs 1 lakh and costs of Rs 25,000.

The forum directed Suchirindia to refund Rs 5.75 lakh to the complainant along with 12 per cent simple interest after which the complainant should return the property to Suchirindia. The forum also ordered Rs 5,000 towards costs.

One G.V.S.N. Murthy also filed a case and got a relief of Rs 5.75 lakh with interest and Rs 5,000 towards cost.

The complainant alleged, “After seeing the brochures I booked a plot in 2006 by paying an enrolment fee of Rs 5,000, admission fee of Rs 250 and plot reservation charges of Rs 61,000. Suchirindia issued a passbook reserving plots measuring 240 square yards. I paid installments regularly and paid a total of '5.75 lakh by 2008.”

“After a lot of persuasion, Suchirindia executed a sale deed in 2010 for a plot in survey No. 720 in Malkapur Village, Choutuppal Mandal, Nalgonda district. But Suchirindia did not develop the venture as was promised by them in the brochure; they did not lay BT Roads, construct water drain culverts, lay underground sewers along the roads, construct adequate number of overhead tanks or provide electrical lines along the layout roads including street lights with fresh underground cables,” he said.

SuchirIndia claimed in its counter, “We have already developed the venture by incurring huge expenditure and paid the necessary charges to the HMDA authoritie. When all the customers pay the entire amount the opposite parties will be able to develop the venture. Some of the customers have not paid the full amount and as such the opposite parties are unable to develop the venture fully. We are requesting the HMDA authorities to extend the time for developing the venture.”
