Madras HC upholds Lenovo, HP's laptop tender

Justice M. Duraiswamy upheld the award of tender while dismissing a petition filed by Mantra Industries Ltd, an unsuccessful bidder.

Chennai: Madras high court has upheld the tender awarded to Lenovo (India) Pvt Ltd and Hewlett Packard India Sales Pvt Ltd by Elcot for supply of five lakh laptop computers, meant for free distribution to students in Tamil Nadu, during the year 2016-17.

Justice M. Duraiswamy upheld the award of tender while dismissing a petition filed by Mantra Industries Ltd, an unsuccessful bidder.

The tender pertains to a major social welfare scheme of Tamil Nadu government and is intended to benefit lakhs of students by way of supply of laptops.

The judge said the two successful bidders have satisfied all the eligibility condition laid down in the tender document and have satisfied all technical specifications.

The judge said when the technical committee, consisting of experts in the field, reached the opinion that the objections raised by the petitioner were not substantiated and found that as per the reports given by Electronics Testing and Development Centre, all the laptop computers with AMD PRO A4-3350B APU processor have passed the test and conformed the requirement as specified in the tender, no malafide can be attributed to the technical committee and the same should be accepted.

Elcot has validly acted as per the tender conditions in full compliance and awarded the tender to Lenovo and Hewellet Packard.
