Tribunal okays sacking Hyundai technician

After conducting an enquiry, the officer found that he committed misconduct. Amulraj had not appeared before the enquiry officer.

Chennai: The Industrial Tribunal, Chennai has granted approval to South Korean based automobile major for sacking an erring technician from service. The management, Hyundai Motor India Limited, Sriperumbudur sacked him in 2011 after he failed to attend duty repeatedly. In the petition, the automobile major said, P. Amulraj of Mogappair East, was serving as a technician. He was a habitual absentee. A charge memo was issued to him.

When he was asked to give an explanation, he did not file a reply. Hence an enquiry was conducted on February 18, March 9 and 23, 2011 and the enquiry was held exparte on March 31, 2011.

He did not respond to the enquiry officer who found that he committed misconduct under Clause No.21 (33) of Certified Standing Orders. This was communicated to him on April 14, 2011.

After conducting an enquiry, the officer found that he committed misconduct. Amulraj had not appeared before the enquiry officer.

On June 6, 2011, the management issued a show cause notice to him asking why he should not be dismissed. He was dismissed from service on June 22, 2011.

The presiding officer, Industrial Tribunal, A. Kanthakumar, said as per standing order clause 21 (33) the continuous unauthorised absence from duty has been termed a misconduct and the maximum punishment to be imposed under clause 22 of standing order is dismissal from service. The tribunal approved dismissal order.
