Justice AK Goel justifies SC/ST order
New Delhi: Justice A.K. Goel who retired on Friday justified his judgment suspending immediate arrest under SC/ST Atrocities Prevention Act.
In his farewell speech at a function organised by the Supreme Court Bar Association, Justice Goel said: “If courts cannot protect fundamental right of due process, it is better courts are wind up. Becoming a judge is not acquisition of status, but people reposing trust in you and giving you an opportunity to serve.”
He said the dissenting opinion in the ADM Jabalpur case (related to suspension of fundamental right during Emergency), which is today a law, that there can be no arbitrary arrests is what he thought about while delivering that judgment.
“When people come to the court they come with a hope of justice, which is why we should be give judgments promptly.”
