Get back to work at once: Madurai bench of the Madras HC
Madurai: The Madurai bench of the Madras high court on Tuesday passed an interim order directing the striking transport employees to get back to work immediately.
The court also urged the State government to invoke the provisions of Essential Services Maintenance Act against the workers if they fail to comply with the HC order.
When the question was raised before N. Vijayaraghavan, counsel for the insurance company, it was fairly conceded that the terms and conditions of the policy have not been produced before the Tribunal. The duty on the part of the insurance company was not discharged by filing the terms and conditions of the policy. The claim made by the insurance company was not sustainable, the judge added.
Answering another issue as to whether the father can be deprived of the compensation on account of death of his son only on the ground that he was not the person mentioned in the legal heir certificate issued by the revenue authorities, the judge said the legal heir certificate only recognises the pre-existing relationship between the deceased and his relatives and it does not confer any title or right upon the persons named in the legal heir certificate. Just because a person's name was not found in the legal heir certificate, it cannot be a ground to decline the grant of compensation, the judge added.
