HC hears Bandi Sanjay's petition in SSC Hindi paper leak case

HYDERABAD: Chief Justice Ujjal Bhuyan of the Telangana High Court on Friday took on a criminal petition filed by state BJP chief Bandi Sanjay Kumar to quash the criminal case lodged against him in SSC Hindi paper leakage.

Senior counsel L. Ravichander, appearing for Sanjay, said there were multiple contradictions in the case of the prosecution. He said that politics had touched an all-time low with the leader of a political party being victimised on flimsy charges.

Ravichander said that the story of the prosecution was an inelegant attempt to the save the state government from its humungous failure to conduct the examinations and to find a scapegoat. He argued that the invigilators and the student who took part in the so-called leak were not arrayed as parties to the case.

Ravichander read out from the FIR and the remand case diary to argue that at best it could be said that the intention of the petitioner was to exploit the government’s failure. “That is the job of the petitioner and it is unfortunate that he is asked to pay the price for doing his duty,” senior counsel said.

He read out how Sanjay was moved from one place to another on the intervening night of April 4 and 5 in a manner reminiscent of the famous case of D.K. Basu.

Advocate-General B.S. Prasad submitted to the court that the investigation was ongoing and that the petitioner was not cooperating with the investigation. The Chief Justice voiced the hope that all parties would maintain a sense of balance in the polity.

The court issued notice to the de facto complainant, the headmaster of the government school where the question paper was copied and sent through Whatsapp. The matter will now be taken up for the response of the government on June 16.
