Tribunal refuses to pass order on AP's plea against PRLIS

Vijayawada: Krishna Water Disputes Tribunal (KWDT)-II has refused to entertain the interlocutory application (IA) filed by the AP government on Palamuru-Ranga Reddy Lift Irrigation Scheme (PRLIS) over Telangana tapping 90 TMC of water using the project.

The tribunal made it clear that it has no authority to hear such a petition. It advised AP government to approach the appropriate fora.

KWDT-II, comprising its chairman Justice Brijesh Kumar and members Justice Ram Mohan Reddy and Justice S. Talapatra, pronounced its order in New Delhi on the IA-13 filed by AP on PRLIS on Wednesday.

AP filed the interlocutory application on December 8, 2022 to restrain Telangana from giving effect to its GO No. 246 dated 18-08-2022 and utilising 90 TMC in PRLIS out of 75 per cent dependable flows from Srisailam reservoir, pending disposal of the present reference to the KWDT-II under section-89 proceedings.

On February 2, 2023, Telangana filed a counter to the IA. This was followed by rejoinders from both AP and TS. Voluminous documents had been filed by both sides. The tribunal also heard oral arguments on behalf of both the states. Hearings concluded on July 14 this year.

The KWDT-II chairman has now pronounced the order stating that the tribunal does not have jurisdiction to hear this IA. It has given liberty to AP to move appropriate fora.
