Bengaluru: The 8th ACMM court on Wednesday remanded Mohammed Nalapad Haris, expelled Bengaluru Congress Youth Wing General Secretary and son of Shanthinagar MLA NA Haris, and his six associates to 14 days in judicial custody for brutally assaulting 24-year-old Vidwath at Farzi Cafe in UB City on Saturday night. Vidwath is the great, great, great grandson of the Diwan of Mysore State, K Sheshadri Iyer.
The court however adjourned the hearing on Nalapad’s bail plea which he had filed on Wednesday morning after the public prosecutor advocate, Shyam Sundar who represented the victim Vidwat, sought time to file objections. The court will hear Nalapad’s bail plea on Friday.
After the court pronounced the judgment, Nalapad and his associates were taken to the Parappana Agrahara Prison where they will be lodged till March 7. The accused include Nalapad, Arun Babu, Manjunath (Driver cum bouncer of Mohammad), Mohammed Ashraf (a B.Com graduate and unemployed), Balakrishna (driver), Abhishek (BBA graduate and small-time businessman) and Mohammed Nasir (BBM graduate and associate of Nalapad). The police are searching for more people involved in the assault including one Srikrishna who are at large.
Vidwath recovering, still in icu
To the relief of the family of 24- year- old Vidwath, who is still in the ICU at Mallya Hospital after being brutally assaulted by Congress MLA, N A Haris’ son, Mohammad Nalapad Saturday night, he appears to be recovering.
“Vidwath is doing reasonably well and his facial swelling has reduced by 50 per cent. We will, however keep him in the ICU for another four or five days for observation and closely monitor his saturation levels which are currently at 90-95 per cent. Until they improve, we will keep him here. But he is on the right track," said Dr Anand K, consulting plastic surgeon, Mallya Hospital, who is his treating physician.
While the doctor suspects damage to his lungs owing to his fractured ribs, he doesn’t think he requires surgery at this time. "There is the pain because of the fracture and there might be borderline damage to the lungs,” Dr Anand said.
Fearing that the state public prosecutor could come under pressure from the ruling Congress, Mr J Loganathan, father of L. Vidwath, who was brutally beaten up by MLA N A Harris’s son, Mohammad Nalapad Haris and his gang Saturday night in a city restaurant, has written to the government asking for the appointment of a special public prosecutor to try the case.
He has made the same plea in an impleading application before a lower court, which could rule on it on Thursday. In his letter to government officials and the director of prosecution, Mr Loganathan said Nalapad had picked a fight with his son and assaulted him. He later followed him to the hospital and tried assaulting him there as well, which clearly revealed his intention to kill Vidwath, he claimed.
“The audacity of the prime accused is because of his father, N A Haris, a local MLA of the ruling party, who has clout in the government,” he charged.
Claiming that the city police had been influenced in the case, Mr Loganathan feared the state public prosecutor too could come under similar pressure and suggested that advocate Shyamsundar be appointed special public prosecutor for the sake of impartiality.
Activist and industrialist, Alam Pasha also impleaded in the case before the lower court, asking that he be heard before it passes any order. He called for an impartial investigation into the case. Meanwhile, Nalapad’s advocates have opposed the impleading applications and sought time to file their written objections to them.
