SC decision on triple talaq: Khula' cases might rise, say activists
Hyderabad: With the Supreme Court granting a stay on instant talaq, women activists feel there is scope as men would prefer not give talaq but could force the women take ‘khula’.
Khula is a procedure through which a woman can divorce her husband in Islam, by returning the dower (mahr) that she received from her husband. However, the husband has the final authority to grant the woman divorce.
“Generally, we do not get cases of talaq for various reasons. Instead, women along with their families approach us and seek help in taking ‘khula’ from their husbands,” Qazi Habeeb Ahmed Bin Salam Al Attas told this newspaper. Ms Jameela Nishath, said the number of Khula cases are more.
“When the harassment or torture of the husband becomes unbearable the women apply for Khula from their husband. The cases of Khula are more in numbers than of talaq,” she said. Ms Nishath feels, the government should introduce a law within six months on talaq or else men will force their wives to take ‘Khula’ to be on safer side.
