Move Supreme Court on sharing of assets with AP, Telangana tells Centre
Hyderabad: Telangana Chief Minister K. Chandrasekhar Rao has asked the Centre to file an affidavit in the Supreme Court in support of the Telangana government over sharing of assets and liabilities of common institutions listed under Schedule X of the Andhra Pradesh Reorganisation Act, 2014.
He said that Andhra Pradesh could not seek a share in assets and liabilities in the ratio of population by citing Supreme Court orders on the APSCHE issue. About 142 institutions have been listed under Schedule X.
Mr Rao said sharing them with AP would cause huge financial loss and administrative inconvenience to Telangana state. The CM found fault with the stand taken by the Centre’s solicitor-general in this regard in favour of AP and stated that it was contrary to provisions of the AP Reorganisation Act.
He urged the Centre to adopt the same methods that were implemented during the bifurcation of Uttar Pradesh, Madhya Pradesh and Bihar.

“In the matter of assets, liabilities and continuation of the facilities in Schedule X institutions, the TS government has taken a consistent approach, which is strictly in compliance with the provisions of the AP Reorganisation Act. AP government on the other hand has claimed that these institutions’ assets and liabilities are to be divided in the population ratio and pending such a division, the institutions are to be managed jointly,” wrote Mr Rao.
The CM brought to Centre’s notice that, “A small number of these institutions are parts of departments which are exclusively dependent on the government for staff and budget, whereas the majority of the institutions have their own sources of income and do not depend on the government for their functioning.
“In all such cases, it would not be correct to club the assets and liabilities of the erstwhile state of Andhra Pradesh. These institutions have independent legal existence and there is specific provision in the Act, which is Section 75, as to continuation of the facilities in these institutions.”
Mr Rao observed that the stand taken by the solicitor general on behalf of the Centre was contrary to provisions of the Act and necessary directions may be issued to review this.
The CM stated that the TS government had also filed a review petition in Supreme Court regarding the APSCHE case. The AP government, meanwhile, has decided to also write to the Union Home Ministry to take a decision on sharing of assets and liabilities of institutions listed in the 10th Schedule of AP Reorganisation Act according to the Supreme Court Judgement.
