CAT no' to extending service of retired IPS officer over DoB
Chennai: Stating that the date of birth mentioned in the application for All India Service examinations would be conclusive, the Madras Bench of Central Administrative Tribunal has refused to pass an interim order extending the service of an IPS officer, who retired recently.
The petitioner, S. Rajendran, who retired as ADGP on January 31, 2016, prayed the CAT to extend his service as his father furnished a wrong date of birth.
According to Rajendran, he was recruited as an IPS officer in 1977. His illiterate parents had 10 children. Two among them were born on 15/01/1956 and 15/01/1959 respectively.
His father, in an attempt to get him admitted in school, furnished a wrong date of birth as 15/1/1956 instead of 15/1/1959. In 1994, Rajendran came to know about this and approached the Judicial Magistrate, Attur, for making necessary correction. After enquiry, the Judicial Magistrate passed an order in 1996 and based on this, he filed representations to the State Home Secretary.
It was forwarded to Union Department of Personnel and Training, on September 5, 2014. According to Rajendran, he sent a petition to Central Government. Meanwhile, he also filed a petition before CAT in 2014, which directed the authorities to consider his representation in four weeks. Passing an order in his second petition filed in the following year, the Bench directed the authorities to alter the date of birth in his service book in four weeks.
As there was no response, he filed the present petition and challenged an order passed by the Central Government on December 23, 2015 rejecting the petition.
