Probe against sitting Supreme Court judge sought

It was understood that the panel had informed the CJI that it couldn't conduct a probe against a sitting Supreme Court judge.

New Delhi: The International Council of Jurists (ICJ) has urged the Chief Justice of India J.S. Khehar to set up a committee to probe into the allegations of irregularities against a senior sitting apex court judge.

In a petition submitted to the CJI, the ICJ president Dr. Adish C. Aggarwala said normally this Council never looks into matters related to working of the judges, appointment and removal of judges. The Council involves itself in the rarest of the rare cases in that respect.

The ICJ sought CJI’s intervention to appoint an in-house committee consisting of judges of Supreme Court to look into the allegations against a senior judge.

The ICJ pointed out that the in-house inquiry committee headed by Punjab and Haryana High Court Chief Justice S.J. Vazifdar and comprising Tripura High Court Chief Justice T. Vaiphei and Allahabad High Court’s senior Justice Arun Tandon, which probed allegations against two Orissa High Court judges, was reported to have abruptly ended the investigation on the ground that name of one sitting SC judge had cropped up.

It was understood that the panel had informed the CJI that it couldn’t conduct a probe against a sitting Supreme Court judge. It is in this context that the ICJ is seeking Chief Justice’s intervention, Mr Aggarwala said.
