Miyapur lands belong to govt, says Telangana HC
Hyderabad: The Telangana High Court on Tuesday upheld the decision of the Serilingampally Mandal Tahsildar in canceling the General Power of Attorney (GPA) registrations related to the controversial Miyapur lands in Ranga Reddy district.
While dismissing the two petitions filed by Mr P.S. Parthasarathy and Suvishal PowerGen seeking to suspend operation of the orders issued by the Serilingampally Mandal Tahsildar cancelling the GPA registration documents, Justice P. V. Sanjay Kumar observed that the court could not allow lands worth crores of rupees to fall in the hands of private persons and that the court could not close its eyes on such issues.
The petitioners’ counsel urged the court to issue directions to the concerned authorities not to interfere with the deed of the irrevocable GPA and Sanad rights of the petitioners as the subject lands were obtained lawfully from Ameerunissa and others who were the legal heirs of Jagirdar Kaisaruddin. “The Tahsildar has no power to cancel the registered deeds,” he argued.
Advocate General Mr B. S. Prasad submitted that Miyapur was a part of the Jagir villages which were canceled along with Kesarajwala, Vaklagam, and Bahadurpalli, and that the government lands worth crores of rupees situated in survey numbers 20, 28, 44, 45, 100, and 101 were registered in the favour of the petitioners in the name of Sanad rights. In fact, no heirs can claim any rights on the subject lands since compensation was paid to Jagirdar Kaisaruddin.
“In the year 2003, the High Court and the Special Court for the Prevention of Land Grabbing had made it clear that the subject lands belong to the government. About Rs 265 crore loss was incurred by the state exchequer due to the non-payment of stamp fee and registration fee. The Tahsildar canceled the registration deeds since the land belongs to the government,” the counsel said.
