GHMC directed to demolish illegal structures at Khanammet
Hyderabad: Justice T. Vinod Kumar of the Telangana High Court on Tuesday directed the GHMC to remove unauthorised structures at Khanammet village. The judge was dealing with a writ petition filed by G. Bala Subba Naidu alleging that K. Jaya Rami Reddy and others had illegally erected structures over land without authorisation and that the GHMC had filed to prevent them. The petitioner said that the GHMC issued notices and remained silent. The GHMC said acknowledged the structures were unauthorised and said it would take action in accordance with the law. The judge took an undertaking from the GHMC to this effect.
No help for petitioner with unclean hands
A two-judge bench of the Telangana High Court on Tuesday reiterated that High Court will not exercise its extraordinary jurisdiction in favour of a person who has approached the court with unclean hands. The bench of Chief Justice Alok Aradhe and Justice J. Anil Kumar accordingly dismissed a writ appeal filed by one Jukanti Nirmala. Earlier, she had filed a writ petition to set aside an order of the special tribunal under the Record of Rights Act, describing certain properties in Kolanupuka of Aler mandal in favour of the contesting private respondents. The changes made in the revenue records came up for challenge before a single judge, who refused to grant any relief on the ground that the writ petitioner was guilty of suppressing facts and that she had not approached the court with clean hands. The single judge had imposed Rs 25,000 costs. Echoing the principle, the bench quoted apex court rulings which said that suppression of relevant facts amounted to coming to court with unclean hands.
Plea on facilities for PwD kids put off
A Telangana High Court bench of Chief Justice Alok Aradhe and Justice J. Anil Kumar deferred hearing of a PIL on the plight of visually impaired children. It was dealing with a PIL on poor facilities at the government schools for visually impaired children, taken up suo motu from newspaper articles. Earlier, senior counsel submitted a report to the court after visiting the schools and stated that while the government was sensitive to the challenges, it was at the execution level that there were failures. The bench adjourned the matter by three weeks to allow the government to file its counter.
Ex-cop challenges his dismissal
Justice Pulla Karthik directed the government and the Director General of Police to file counters in a petition filed by n former inspector who alleged he had been unfairly dismissed from service, and posted the matter to December 26. The petitioner, K. Nageswar Rao, said dismissal orders passed by the DGP and the IGP were contrary to Article 3112b of the Constitution read with Rule 25 ii of Telangana State Civil Services CC and A Rules 1991, alongside with judgments of the Supreme Court.
