HC to Hear Dasoju, Kurra Plea Against Governor's Rejection of MLC Nomination
Hyderabad: The Telangana High Court on Tuesday directed the High Court Registry to allow and register the petitions filed by Dr. Dasoju Sravan and Kurra Satyanarayana, whose names were recommended by the erstwhile BRS government for the post of MLC under the Governor Quota but were rejected by the Governor citing reasons “not an eminent person and has political affiliation and is not entitled to be nominated for MLC posts”.
The Governor also had said that neither Dr Sravan nor Satyanarayana met the criteria laid out for nominations under the Governor’s quota as per provisions of Article 171 (5). The Governor had also stated that "my earnest request to the Cabinet and the Chief Minister is to avoid such politically-aligned persons to fill up nominated posts under Article 171(5) of the Constitution of India, defeating its objectives and enactment."
Challenging the Governor's decision in rejecting the erstwhile Cabinet decision, Dasoju Sravan Kumar and Kurra Satyanarayana on December 7, 2023, filed the separate petitions. They made the Governor's office represented by the Secretary, Chief Secretary and general administration department as the respondents to the cases.
The Registry of the Telangana High Court raised some objections on their petitions and placed them before the Chief Justice Bench for the decision. The objections came for hearing on Tuesday and Aditya Sondhi, senior advocate appeared for Dr Dasoju Sravan and Mayur Reddy, senior counsel, appeared for Kurra Satyanarayana.
The Chief Justice Bench directed the Registry to register the cases and objections raised by the Registry got overruled. Now, the High Court Registry will allot the regular numbers to the writ petitions. However, the issue of the maintainability of the said petitions will be kept open and it would be decided after it came for hearing before the Bench on January 5.
