HC Not Inclined to Issue Directions to DGP About Cases Against Poll Contestants
Hyderabad: The Telangana High Court was not inclined to issue directions to the DGP to provide information about criminal case details of candidates contesting the Assembly elections.
Refusing the plea of Mandal Parameshwar Reddy, Congress candidate from Uppal, Justice C.V. Bhaskar Reddy asked him to show the provision of law under the Criminal Procedure Code, which says that the information sought by a petitioner must be furnished.
The judge reminded counsel for the petitioner about a similar case, which was filed in the Supreme Court by a senior advocate under Article 32, saying that the information of criminal cases pending against his client should be uploaded in the police website. The apex court asked the senior advocate to show the provision under the CrPC that such information can be divulged
The judge observed, “if you are confident that you are a genuine candidate, then you go ahead with your canvassing. Why are you coming to the court?”
Adjourning the writ petition to November 10, the judge asked counsel for the home department to get instructions on this issue as the petitioner’s counsel contended that the nomination papers of his client will be rejected, if such information is not furnished to the Election Commission.
