BJP challenges Bandi Sanjay's arrest in HC, hearing today
HYDERABAD: The BJP on Wednesday filed a habeas corpus writ petition with the Telangana High Court for securing the release of its state president Bandi Sanjay Kumar, who was arrested by the Karimnagar police over an SSC question paper leak.
Samreddy Surender Reddy, the Bhagyanagar zilla chief of BJP, filed the petition on behalf of the party. He alleged that the police did not follow the due procedure for arresting Bandi Sanjay and impleaded the court to direct the police to produce him in court and set him free.
Surender Reddy also cited Bandi Sanjay’s cardiac issues and the recent demise of Sanjay’s mother-in-law as grounds for release.
As Wednesday was a court holiday, a division bench headed by Justice Abhinand Kumar Shavili will hear the case on Thursday.
After filing the petition, BJP counsels said that the speaker of the Parliament should be informed of the incident, given that Sanjay is a member of the Parliament.
They also questioned how Bandi Sanjay could be arrested without notice under Section 41A of the CrPC. They claimed it was a violation of Supreme Court guidelines, as stated in the Arnesh Kumar case.
