Hyderabad: The Supreme Court on Monday upheld the verdict of the Telangana High Court pertaining to 31 acres of land in Shamshabad. The apex court dismissed the petition of the land grabbers, whom the HMDA accused of submitting fake documents.
A division of the Supreme Court, comprising Justice Vikram Nath and Justice Satish Chandra, dismissed the SLP petition against the HMDA, which had submitted to the court that the documents and records pertaining to the sale certificate (dated January 27, 1968) by the private person were fabricated. It further submitted that as per the records of the registrar the names were not registered. HMDA officials attended the Supreme Court hearing on Monday and handed over details pertaining to the said lands in Shamshabad.
Based on the evidence and records that were submitted by the HMDA, the Telangana High Court concluded that the documents submitted by the private party were fabricated.
Property tax notices, municipal permission, revenue records, electricity bills, the NOC (dated April 20, 2023) issued by the gram panchayat, Shamshabad mandal in the name of the private parties were all found to be forged.
Considering all the facts, the court said that the private person did not come with clean hands and hence, it was not inclined to give any relief to him.
Mukul Rohit argued on behalf of the petitioner, while Siddhartha Ludra and Supreme Court advocate Daveena Saxena represented HMDA.
