HC Division Bench sets aside the single judge orders in land dispute case at Amberpet

Hyderabad: The division bench of the Telangana High Court comprising Chief Justice Ujjal Bhuyan and Justice C.V. Bhaskar Reddy set aside the orders of a single judge on three parcels of land measuring approximately 2,998 square metres adjacent to Bathukamma kunta in Amberpet, Nampally.

The division bench allowed the writ appeal filed by the Hyderabad district collector and revenue authorities who had challenged the orders of single judge that were issued on August 17, 2016.

The single judge had determined that the land was privately owned, and the government must initiate land acquisition proceedings if it intended to use it. Following this, the Hyderabad collector filed an appeal.

After hearing the contentions on both sides, the division bench directed the writ private parties to approach the appropriate civil court and file a suitable civil suit on the dispute. It instructed the lower court to handle the proceedings impartially, without being influenced by any observations made by the division bench.
