HC prioritises PIL against FTL land acquisition

HYDERABAD: The Telangana High Court on Monday directed its registry to number the PIL that questions the state’s action in initiating land acquisition proceedings for acquisition of land in FTL (full tank level) at Kotha Cheruvu for construction of a road connecting NH61 with Bangalpet in Nirmal town.

Earlier, the court had issued directions to the district collector to fence the FTL land on coming to know that the government had proposed to construct the district court building there.

Instead of fencing it, the government recently decided to lay the road on FTL land. Opposed to this decision, a contempt case was filed.

In the instant PIL the Registry has taken office objection in numbering the Writ Petition (PIL) stating that the cause taken up was beyond the purview of the public interest litigation.

Senior counsel T. Surya Karan Reddy drew attention of the court about the earlier findings, where the court had clearly mentioned that the petitioner is free to approach them if in future the state interferes within the water body and its FTL.

Chief Justice Ujjal Bhuyan overruled office objections and directed the instant W.P (PIL) to be numbered and posted it for hearing on February 17.
