Pay up for unauthorised constructions: Telangana HC

HYDERABAD: A two-judge bench of the Telangana High Court comprising Chief Justice Alok Aradhe and Justice N V Shravan Kumar on Friday dismissed a plea challenging the demand notice of the District Collector towards regularization fee. A writ appeal was sought by Eeranki Harika against the order of a learned single judge for dismissing her plea against a demand notice issued of Rs. 10,74,850/- for regularisation of her illegal and unauthorized construction. Harender Prasad, Special Government Pleader contended that if an application is made for regularization of unauthorized construction by encroaches and a sum is deemed to be liable to be paid as per the Act, the same cannot be exempted since it significantly affects the public exchequer. The Chief Justice speaking for the bench said, 'extraordinary discretionary jurisdiction in favour of encroachers will not be entertained and the court will not appreciate dishonest conduct'. The bench also observed that there will be no indulgence from the court in such matters considering it’s a public property and any party is bound by the policy decision taken by the State Government.
