HC stays State Human Rights Commission order on demolition

Hyderabad: A two-judge bench of the Telangana High Court stayed an order of the Telangana State Human Rights Commission (TSHRC) directing the municipal authorities to demolish a cattle shed allegedly raised without permission. The bench of Chief Justice Alok Aradhe and Justice T. Vinod Kumar was dealing with a writ petition filed by Jagadeeshwar Reddy who said that the action of the TSHRC was beyond its powers mentioned in Section 12 of the Protection of Human Rights Act, 1993. The bench making it clear that it is not for the SHRC to deal with matters pertaining to marital or civil disputes disposed the petition.

HC stays hiring of SCCL asst engineers

Justice P. Madhavi Devi of the Telangana High Court stayed the recruitment of assistant engineers at the Singareni Collieries Company Limited (SCCL). The judge was dealing with a writ petition filed by Palle Sindhuja alleging discriminatory practices in the recruitment process. The petitioner alleged that a circular issued by SCCL in March 2023 lacked provisions for women reservations, thereby violating the fundamental rights. The petitioner contended that the circular's exclusion of days spent on maternity and child care leave from the calculation of service tenure was arbitrary and infringed on the constitutional rights. Accordingly, the judge directed SCCL to refrain from finalising recruitments until the issue was addressed. The judge will hear the matter on Wednesday.

RBI gets notice on retirement benefits

Justice P. Madhavi Devi of the Telangana High Court ordered notice to the Reserve Bank of India (RBI) in a writ plea challenging withholding of superannuation benefits by the bank. The judge was dealing with a petition filed by K. Ramesh Babu alleging that RBI has withheld his superannuation benefits without adhering to the due process of law. He said that the bank had neither granted him an opportunity to present his case conduct an inquiry prior to withholding the benefits. This was contrary to Section 41 of the Payment of Gratuity Act, 1972, and Regulation 472 of the RBI Staff Regulations, he said which entitled him to a fair and just treatment. He said the final order issued by the bank's competent authority on April 6, 2016, led to his immediate dismissal from service, along with the annulment of his service and denial of various benefits, including pension. The petitioner RBI’s action was arbitrary and in violation of his constitutional rights. The court posted the matter to September 11.
