Bench suspends GO on municipal tax in Nizamabad

The writ petition challenges the GO fixing tax based on the category of location of the establishment and road width

Hyderabad: A division bench suspended a GO fixing municipal tax on the basis of square feet rates to hospitals and nursing homes in Nizamabad. The writ petition filed by Indian medical association, Nizamabad, challenges the GO fixing fee for grant of tax and renewal of trade incense based on the category of location of the establishment and road width.

The petitioners contended that exercise of such powers was, under the Municipalities Act, without jurisdiction since hospitals and nursing homes being taxed were within the jurisdiction of Nizamabad municipal corporation. The bench suspended the GO fixing the impugned levy.
